Petitioners are granted liberty to prefer appeal under Section 29 of the Protection of Women from Domestic Violence Act before the learned Sessions Judge in respect of the order dated 08.01.2024. The grievance of the petitioners relates to the interim maintenance and also the amount awarded for alternative accommodation behind the back of the husband by way of a put up petition.

Be that as it may, since the petitioner has directly approached this Court from the order passed by the learned Additional Chief Judicial Magistrate, Berhampore, I am of the opinion that the petitioners should first approach the learned appellate court as no question of exceptional circumstances exist in the present case.

With the aforesaid observations, the revisional application being CRR 1524 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

Department is directed to return the certified copy to the learned advocate-on-record of the petitioners after the same is replaced by photostat copy.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
