The State of West Bengal Mr. Bitasok Banerjee Ms. Debangana Bhattacharya ..for the petitioner Mr. Subir Ganguly, Mr. Sandeep Prasad Shaw ..for the State The petitioner challenges an order dated December 16, 2025, passed by the learned Additional Chief Judicial Magistrate, Rampurhat, Birbhum, whereby a warrant of arrest was issued against the petitioner in connection with G.R. Case No. 383 of 2010 arising out of Margram Police Station Case No. 43 of 2010 dated May 6, 2010, registered under Sections 279 and 304 of the Indian Penal Code, 1860.

Learned counsel appearing on behalf of the State submits that the petitioner is willing to surrender before the learned Magistrate.

In view of the aforesaid submission, the warrant of arrest issued against the petitioner is stayed for a period of one month from the date of this order, subject to the condition that the petitioner shall surrender before the learned Magistrate within the said period.

In the event the petitioner surrenders before the learned Magistrate, any application for bail filed by him shall be considered and decided in accordance with law without being influenced by this order.

In the event the petitioner fails to surrender in terms of this order within the stipulated period, the warrant of arrest shall stand revived automatically, and the learned Magistrate shall be at liberty to execute the same in accordance with law. Accordingly, CRR 1783 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
