No. 29 CHC Rejected C.R.M.(A) 1710 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Murutia Police Station Case No. 223 of 2022 dated 11.09.2022 under Sections 21(C)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

And In the matter of : Rejabul Mandal ...... petitioner Mr. Sumanta Das ....for the petitioner Mr. Avishek Sinha ....for the State There are call record details of conversion between the petitioner and the person arrested with the commercial quantity of narcotics.

Apparently, petitioner used a sim card registered in the name of a different person to contact the person arrested with commercial quantity of narcotics.

In such circumstances, we are of the view that petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985.

Consequently, we are unable to grant anticipatory bail to the petitioner.

CRM (A) 1710 of 2023 is rejected.
