IN THE HIGH COURT AT CALCUTTA

Item No.8 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.

C.R.R. 1363 of 2012 (Via Video Conference) Smt. Suniva Mondal @ Suniva Rani Mondal versus The State of West Bengal & Anr.

In Re: An Application under Section 482 of the Code of Criminal Procedure.

Mr. Krishnendu Bhattacharya, Mr. Bhaskar Prasad Banerjee, Mr. Priyankar Ganguly ... For the Petitioner.

Mr. Arijit Ganguly, Mr. Saryati Datta ... For the State.

This revisional application was preferred challenging the FIR registered in connection with Baguiati Police Station Case No. 196 dated 10.04.2011.

Mr. Bhattacharya, learned advocate appearing for the petitioner submits that the present petitioner is mother-inlaw of the informant and she has been unnecessarily roped in, although she was not available at the matrimonial home and was staying at Singapore.

Mr. Datta, learned advocate appearing for the State submits report of the concerned Officer of Baguiati Police Station. The said report dated 26.09.2021 be kept with the record.

The report reflects that on conclusion of investigation, charge-sheet has been submitted and the next date has been fixed on 18.01.2022 for supply of copies.

In view of the change of circumstances, I am of the considered opinion that the contention advanced by the petitioner at this stage becomes diluted in view of the prosecution already filing a report under Section 173 of the Code of Criminal Procedure. As such, no interference is called for at this stage.

The petitioner is granted liberty to approach this Court afresh after copies under Section 207 of the Code of Criminal Procedure are available to her.

The revisional application being CRR 1363 of 2012 is, thus, dismissed.

Interim order, if any, is hereby vacated.

All pending applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
