Learned counsel for the petitioner submits that pursuant to an order passed by this Court in an earlier writ petition being W.P.No. 30524(W) of 2017 on January 05, 2018, the petitioner approached the Block Land and Land Reforms Officer (in short, "BL&LRO") for correction of record of rights and incorporation of his name in respect of the land in question. The petitioner's prayer was dismissed by the BL&LRO for which the petitioner approached the West Bengal Land Reforms and Tenancy Tribunal in Original Application No. 3345 of 2024 which is pending.

The earlier writ petition was filed by the petitioner seeking identical reliefs as in the present application. In

disposing of the said writ petition, a coordinate Bench of this Court observed that in view of civil dispute between the parties it would not be proper to interfere in the writ petition. The parties were granted liberty to seek remedy before the appropriate forum, in accordance with law.

The present writ petition filed on the self same grounds as the earlier writ petition is not maintainable, being barred by res judicata.

The writ petition is accordingly dismissed.

There shall, however, be no order as to costs. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
