Records of the writ petition reflect that the 22.07.2025 Court No. 35 M/L. No.818 Rakib petitioner has approached this Court for initiation of proceedings on the basis of the information furnished on 30th January, 2024.

State has submitted a report. Report reflects that there is a long standing land dispute already existing between the petitioner and the private respondents. Report also reflects that on the basis of the information furnished on behalf of the petitioner and/or his associates Bhatpara Police Station case no. 879/23 was registered for investigation and on conclusion of investigation charge-sheet has been submitted before the jurisdictional Court. It is also reflected in the report that Bhatpara Police Station case no. 902/23 was registered pursuant to the information furnished by one Rinku Das and the said case was against the petitioner and/or his associates. It is also reflected that charge-sheet has been submitted in connection with the said case. Police authorities also at the relevant point of time have drawn up proceedings under Sections 107/116 of the Cr.P.C.

Having regard to the fact that a long standing land dispute is existing between the petitioner and the private respondents and the records reflect that number of criminal cases and counter cases are pending before the jurisdictional Court, I am of the opinion that in case, the petitioner is faced with some inconveniences for which the police authorities did not act, petitioner will approach the jurisdictional Magistrate for appropriate remedy. No further interference is called for at his belated stage. Accordingly, WPA 10334 of 2024 is disposed of. Pending application, if any, is consequently disposed of.
