Mr. Bidyut Kumar Halder, Mr. Indranil Halder, Ms. Srabanti Das, Ms. Neha Singh ...for the petitioner Mr. Debjit Mukherjee ...for the CESC Limited Learned counsel for the petitioner argues that despite having applied for a new electricity connection in her name, the petitioner has not been given such connection by the CESC Limited as yet. It appears from the communication dated September 30, 2022, annexed to the writ petition that the CESC Limited informed the petitioner that their site inspection and verification of records revealed that more than one application in favour of the petitioner at the same premises was under process.

At the time of argument, learned counsel appearing for the CESC Limited submits that the spouse of the petitioner is already enjoying an electricity connection at the same premises, for

which the CESC Limited apprehends splitting of load in the event another connection is given to the petitioner. However, it is candidly submitted by learned counsel for the CESC Limited that such communication has not yet been made to the petitioner.

Be that as it may, since it is evident from the submission of the CESC Limited, made on instructions, that the CESC limited has a specific dispute as to the apprehended splitting of load if the connection is given in the name of the petitioner, it is the concerned Grievance Redressal Officer (G.R.O.), who is the competent authority to decide such issue.

Accordingly, W.P.A. No. 9497 of 2023 is disposed of by granting liberty to the petitioner to approach the concerned G.R.O. with the disputes as raised in the present writ petition.

Upon such approach being made, the G.R.O.

shall give an opportunity of hearing to both sides and decide the issue in accordance with law, as expeditiously as possible, positively within eight weeks from the date of communication of this order to the G.R.O.

For the purpose of compliance, the G.R.O shall act on the server copy of this order, without insisting upon prior production of a certified copy thereof.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
