Learned Senior Advocate appearing for the petitioner submits that the petitioner no. 1 is in custody for 440 days, petitioner nos. 2 and 3 are in custody for 241 days and till date out of 22 witnesses cited by the prosecution, only 3 witnesses have been examined. It has also been submitted that another accused namely, Meheraj Sk. has been granted bail in CRM (DB) 22 of 2025 and the 3 petitioners are similarly placed as the other accused who has been granted bail.

Learned advocate for the State opposes the prayer for bail and produced the case diary. Attention of the Court is drawn to the statement of one Jamshed Sekh.

Learned advocate for the defacto complainant is also present and opposes the prayer for bail.

On an assessment of the same, I find that the aforesaid 3 petitioners are similarly placed as Meheraj Sk. who has been granted bail.

Accordingly, the present petitioners namely, (1) Bandel Sk @ Anar Sk, (2) Jangal Sk. @ Anarul Sk and (3) Md. Helaluddin be released on bail on same terms and conditions on which the other accused, Meheraj Sk. was released on bail in CRM (DB) 22 of 2025.

Thus CRM (M) 1035 of 2026 is allowed.
