Heard learned counsels for the parties.

The petitioner seeks consideration of the representation submitted by him before the Secretary, Regional Transport Authority, Purba Burdwan requesting issuance of offer letter in his favour.

The petitioner applied for grant of stage carriage permit on the route Khandoghosh to Arambag which was approved by the authority in its board meeting held on December 03, 2022. The petitioner has deposited the requisite fees as directed by the authority. Since the route covers 2 regions, the Secretary, Regional Transport Authority, Hooghly was requested to grant No Objection Certificate (in short, "NOC") in favour of issuance of such permit and by a letter issued on January 09, 2024, the said authority decided to issue such NOC for the route in question subject to production of amicable time table from the existing operators.

In view of the above, this Court is inclined to hold that since the Regional Transport Authority, Hooghly has agreed to issue NOC in favour of the petitioner in respect of the route in question, the Secretary, Regional Transport Authority, Purba Burdwan being the 4th respondent herein be directed to consider the representation submitted by the petitioner and take necessary steps for issuance of offer letter in his favour within four weeks from the date of receipt of NOC from the Regional Transport Authority, Hooghly subject to the petitioner complying with all requisite formalities, in accordance with law. With the above observations and directions this writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
