Heard the learned Advocates for the parties.

We have considered the materials on record.

Narcotics substance i.e. 10 ltrs. of codeine mixture above commercial quantity was recovered from the petitioner. Co-accused have been enlarged on bail. No narcotics was recovered from co-accused who are on bail. They do not stand on the same footing with the petitioner. Under such circumstances and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.
