The only reason for interference with the order of His Lordship is that the appellant was not available when the order impugned was passed. It is submitted that the learned advocate had missed the list. Thus, the order impugned before us will remain stayed for a period of three weeks or until further orders of His Lordship, whichever is later. The appellant is granted liberty to approach His Lordship with a prayer for urgent hearing of the matter. We are not expressing any opinion on the order impugned. We are of the view that the appellant should be heard before the order is implemented. We allow the

appellant to agitate all points which have been raised in the appeal.

Accordingly, the appeal and the application are disposed of.

Parties are directed to act on the basis of the server copy of this order.
