The revisional application was preferred against the order dated 19.04.2011 passed by the learned Chief Judge, City Sessions Court, Calcutta in Criminal Appeal NO. 6 of 2011 which arose out of an order dated 12.10.2010 passed by the learned Metropolitan Magistrate, 13th Court, Calcutta in complaint case no. C.8964/2005.

As the subject matter of the case involves the issue of conviction and sentence, I am not inclined to dispose of the revisional application on merits. The records of the revisional application reflects that on 18.05.2011 a Coordinate Bench of this Court was pleased to direct the petitioner to deposit of sum of money. Till date no compliance has been shown before this Court regarding the said order so passed.

In view of the observation made above the revisional application is dismissed for default.

Learned Metropolitan Magistrate, 13th Court, Calcutta is directed to execute the sentence.

Department is directed to communicate this order to the learned Metropolitan Magistrate, 13th Court, Calcutta. Interim order, if any, is hereby vacated.
