The grievance of the petitioner is that the Staterespondents are trying to construct a road through the land owned and occupied by the petitioner. The petitioner submitted representation before the concerned authority on April 27, 2022 in this regard which is yet to be disposed of. The petitioner prays for direction upon the authority to consider the said representation at the earliest.

Upon consideration of the submission made by the learned counsels appearing on behalf of the parties and the material on record, the writ petition is disposed of directing the respondent no. 3 to consider and dispose of the representation submitted by the petitioner on April 27, 2022 within a period of one month from the date of communication of this order, after affording reasonable opportunity of hearing to all the interested parties including the petitioner, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. Pending disposal of representation, there shall be an order of status quo upon both the parties with regard to the nature, character and possession of the plots in question as on this day.

With the above observations and directions this writ petition being WPA No. 9163 of 2022 is disposed of. There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
