The revisional application was preferred challenging the order dated 08.03.2011 passed by the learned Additional Chief Judicial Magistrate, Bidhannager, North 24 Parganas.

The order dated 08.03.2011 reflects that the learned Magistrate on the basis of the preliminary materials appearing before him directed the opposite party to pay Rs.800/- per month to the wife. Having regard to the reason so assigned by the learned Magistrate, I am of the view that no interference is called for as the award of interim maintenance was by way of an interim measure during the pendency of the main proceedings under Section 125 of the Code of the Criminal Procedure.

Accordingly, CRR 1496 of 2011 is dismissed.

Pending application, if any, is consequently disposed of.

Interim order, if any, is hereby vacated.
