No.819 Rakib information was furnished by the petitioner to the Commissioner of Police, Kolkata as well as the Officer-inCharge, Shyampukur Police Station. It is the contents of such information reflect that two CCTV cameras were installed inside the house and within the territory of the petitioner. Petitioner claims that such CCTV cameras had been installed for intruding her privacy and accordingly informed the police authorities but the police authorities did not respond to the same.

Mr. Karan, learned advocate appearing for the State has submitted a report. Report reflects that the petitioner has already filed a suit being Title Suit no. 464 of 2022 before the learned City Civil Court, Calcutta. Subsequently, another suit being Title Suit No. 472 of 2022 has been initiated.

Since the Civil Court is already in seisin of the issue it would be for the petitioner to approach the Civil

Court to establish that her privacy is being intruded as the report submitted by the police authorities reflect that a dispute is already existing between the petitioner and the private respondents over a property. In case the Civil Court on an appropriate application preferred by the petitioner is of the opinion that the privacy of the petitioner is intruded, then in that case appropriate direction be passed by the Civil Court. If the Civil Court thereafter is of the opinion that police assistance is required, necessary direction be passed upon the police authorities, when the police authorities would respect and obey such order.

Having regard to the time period which has lapsed in the meantime, I am of the opinion that at this belated stage without any evidence it would be difficult for this Court to summarily arrive and adjudicate the disputes canvassed before this Court.

Accordingly, WPA 10345 of 2024 is disposed of. Report so submitted by the State be kept with the record.

Copy of the report be handed over to both the parties.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
