The petitioner alleges that her brother being the private respondent is abusing and threatening her and make her life miserable so that she vacates the property where the siblings stay at present with the sole intention to grab the entire property.

It appears from a report filed by the Inspector-inCharge of Kalyani police station signed on April 16, 2024 that on the complaint filed by the petitioner before the police, an inquiry was conducted and the police submitted non-FIR prosecution vide Kalyani PS NCR No.547/2024 dated March 19, 2024 under sections 107/116(3) CrPC against the private respondent. The property in question belonged to the parents of the parties who are no longer alive. For taking over the entire property, the private respondent is doing all sorts of mischief.

In view of the above, the police are hereby

directed to ensure that there is no breach of peace in the locale and that the life and property of the petitioner is not endangered in the hands of the private respondent. The writ petition stands disposed of.

Certified copy of this order, if applied for, shall be made available to the parties.
