For the State The Advocate-on-record of the petitioner undertakes to affirm and stamp the petition/application as per the Rules within four weeks from date. Subject to such undertaking, the application is taken up for hearing. The petitioner has filed the instant application for bail under Section 439 of the Code of Criminal Procedure in connection with Balurghat Police Station Case No. 476 of 2020 under Section 305 of the Indian Penal Code. The instant case has been filed on the death of a daughter of the de facto complainant who committed suicide as the petitioner used to give indecent proposals to her and also threatened to defame her, in the event, she does not succumb to such unreasonable demands. The petitioner is in custody for nearly 145 days. Even if the charge sheet has been filed, considering the gravity of the allegations leveled against the petitioner, we do not find any justification in releasing the petitioner on bail.
