Undoubtedly, the temporary and permanent structures which were found on the road situated at LR Plot No.210 of mouza Rudranagar, J.L. No.49 under Tahatta-II Block and LR Plot No.4351 of mouza Nischintapur, J.L. No.52, which had been classified as 'DHHAR', had been directed to be removed both by the High Court as also by the Sub-Divisional Officer, Tehatta. The petitioners allege that the said orders have not been carried out by the authorities.

Mr.

Mahata, learned Additional Government Pleader submits, on instructions, that partial removal has been made and a shop room run by the petitioners, is also situated on the aforementioned road. The petitioners undertake to remove the same.

Under such circumstances, the writ petition is disposed of with a direction upon the Block Development Officer, Tehatta-I and the Block Development Officer, Tehatta-II to jointly inspect the area to carry out the demolition work as per the direction of this Court and the direction of the Sub-Divisional Officer.

The entire process shall be completed within a period of one month from the date of communication of this order.

The police authorities shall assist the Block Development Officers in the process.

The report filed by the State-respondents is taken on record.

The writ petition is, thus, disposed of.

There shall be no order as to costs.

Parties are to act on the basis of the server copy of this order.
