Mr. Siddhartha Sarkar Mr. Subhasis Pal ....for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Judge 2nd Bench, City Civil Court at Calcutta to dispose of Title Suit No.1076 of 2021 expeditiously.

In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or their learned advocates appearing before the learned trial judge.

The learned advocate appearing for the petitioner submits that the opposite parties herein are trying to delay the hearing of the said suit.

From the order sheets appended to this application, this Court finds that May 21, 2021 has been fixed for cross-examination of P.W.1 as a last chance.

In the light of the submissions made by the learned advocate for the petitioner CO 1490 of 2025 is disposed

of by requesting the learned Judge 2nd Bench, City Civil Court at Calcutta to make an endeavor to see that the cross-examination of P.W.1 is concluded as expeditiously as possible without granting any unnecessary adjournments to either of the parties. Taking note of the fact that the suit is for recovery of possession and is pending from the year 2021, the learned trial judge is requested to dispose of Title Suit No.1076 of 2021 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
