Petitioner submitted a representation and the subject matter of the grievance was addressed to the Legal Remembrancer, West Bengal as also to the Principal Secretary, Department of Law, Government of West Bengal.

The contents reflects that the petitioner being the de facto complainant was aggrieved in respect of the public prosecutor conducting the case. Mr. Sengupta, representing the learned District Public Prosecutor has submitted a written instruction

wherein he has submitted that in order to avoid any controversy and humiliation, he intends to retire and resign from the series of cases instituted at the behest of the present petitioner.

Since the learned Public Prosecutor has expressed his desire to resign from the cases being Serampore PS Case No. 363 of 2022 and Serampore PS Case No. 184 of 2023, without entering into the legality of the contentions, the Legal Remembrancer, West Bengal is directed to appoint a new Public Prosecutor/ Special Public Prosecutor amongst the panel of Advocates, he deems fit and proper at the earliest.

With the aforesaid observations WPA No.

10365 of 2024 stands disposed of.

Needless to state that since no affidavits have been called for the accusations made in the writ petition are deemed not to have been admitted. A copy of the order be sent to the Legal Remembrance, Government of West Bengal.

Report so submitted be kept with the record.
