No.3834 of 2021 (Via Video Conference) In Re:- An application for bail under section 439 of the Code of Criminal Procedure filed on 01.06.2021 in connection with Sonarpur Police Station Case No. 2611/11 dated 07.12.2016 under Sections 366A/370/370A/372/373/120B/34 of the Indian Penal Code and Sections 3/4/5/6/7/9 of the Immoral Traffic Prevention Act and Sections 4/17 of the Protection of Children from Sexual Offence Act.

And In the matter of:- Anil Bhowmick ... Petitioner Mr. Angshuman Chakraborty .. for the petitioner Mr. Ranabir Roy Chowdhury, Mr. Mainak Gupta ..for the State Earlier on four occasions the petitioner's prayer for bail was rejected. The charge is of trafficking of women. The petitioner says that he is 70 years of old and there is no real possibility of the trial ending at an early date. He suffers from various ailments. He should be enlarged on bail. We had called for a report from the concerned Correctional Home as regards the medical condition of the petitioner. Such report has been filed today. Let the same be kept with the records.

We find from the said report that the petitioner does not suffer from any critical ailment. Age related issues are there and the same are being treated appropriately.

We have seen the material in the case diary, which prima facie implicates the petitioner. We are also told that out of 24 prosecution witnesses, 19 witnesses have already been examined. In view of the above, we are not inclined to allow the present application for bail.

The prayer for bail, is, thus rejected.

Keeping in view the fact that the petitioner has been in custody for about five years and eight months, we request the learned trial court to expedite the trial and bring the same to its conclusion as soon as the business of the court may permit.
