Case No.441 of 2017 dated 22.11.2017 under Sections 302/34/120B of the Indian Penal Code read with Sections 25/27/35 of the Arms Act.
In the matter of : Baban Yadav.
... Petitioner.
Md. Sabir Ahmed, Mr. Bikash Chandra Halder.
...for the Petitioner.
Mr. Madhusudan Sur, Ld. A.P.P., Mr. Manoranjan Mahata.
...for the State.
Heard the learned Advocates for the parties.
Report filed on behalf of the State be kept on record. We have considered the materials on record. Inspite of direction given by this Court, defence lawyers did not cooperate with the trial due to resolution at the local bar and police officers who were present in Court were not examined. This Court does not appreciate such conduct.
In view of the fact that the delay is engineered at the behest of the defence, we do not consider it prudent to enlarge the petitioner on bail.
Accordingly, the prayer for bail of the petitioner is rejected.
