Dalia Chakraborty Mr. Ayan Basu, Mr. Debokli Nandan Maiti, Mr. Sumit Routh .....for the Petitioner Learned advocate for the petitioner is aggrieved by the progress of complaint case no. CNS No. 423 of 2019(F. No. CNS/56300/20019). The subject matter of the proceedings relates to provisions under Section 138 of Negotiable Instruments Act. In view of the statutory provision involved as also the pressure of the Trial Court, I am not inclined to fix a specific schedule within which the Learned Trial Court would complete.

However, having regard to the legislative intent, I direct that the learned Trial Court being the Metropolitan Magistrate, 8th Court Calcutta would fix at least one date on each and every month so that efforts may be taken for concluding the trial within a reasonable period of time.

With the aforesaid observations, CRR 1730 of 2022 is disposed of.
