Learned advocate appearing for the petitioners submits that petitioners have been implicated in connection with the same set of facts by Cyber Police Station, Kolkata, Pragati Maidan Police Station, Kolkata and Beliaghata Police Station. It has been submitted that the petitioners were taken into custody initially by Cyber Police Station, Kolkata. Since after substantial period, the police authorities could not unearth materials, the learned CJM, Calcutta granted bail to the petitioners. Surprisingly the petitioner nos. 2 and 5 were taken into custody in connection with Pragati Maidan Police Station case, but within a close proximity of time, the learned ACJM, Alipore was pleased to release the petitioners on bail.

Petitioners apprehend that they may be arrested in

connection with the case registered with Beliaghata Police Station.

State has submitted reports which reflect that materials have been collected by the investigating agency as also the process in which the investigation is in progress and the genesis of the case. So far as bail of the petitioners is concerned, the same is a different aspect of a criminal proceeding and has got nothing to do with the merits of the case.

Having considered the stage at which the present proceedings are in progress, at this stage, I do not intend to entertain the plea of amalgamation of all the cases as placed by the learned advocate appearing for the petitioners. If charge-sheets are submitted on the selfsame identical facts and evidence, in that case petitioners are granted liberty to approach this Court for consideration of the merits in respect of the subsequent cases so registered.

With the aforesaid observations, the writ petition being WPA 9650 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
