On the verbal undertaking given by the petitioner who is present in court and on the assurance of Mr.
Mastafa, learned advocate appearing on behalf of the petitioner, that the petitioner is ready and willing to vacate the property as and when the construction work starts, no purpose will be served by keeping the writ petition pending.
This matter is disposed of by directing the petitioner to vacate his occupied premises within a week from receipt of the notice of commencement of the development work within the compound of the cooperative society. The petitioner resides within such compound. The keys shall be handed over to the authorized agent of the cooperative society by the petitioner.
No extension shall be given to the petitioner thereafter. The right of the petitioner to occupy the premises has been sufficiently protected by the court, so far.
Till the petitioner continues to reside in the premises, the petitioner shall pay the occupational charges.
With the above directions, the writ petition is disposed of.
There shall be no order as to costs.
Parties are to act on the server copy of this order.
