Banerjee ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned 1st Civil Judge (Jr. Division) at Alipore to dispose of Title Suit No. 4471 of 2014 expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the learned advocate representing the opposite parties before the learned trial judge.

From the order-sheets appended to this application this Court finds that a substitution application is pending.

Learned advocate for the petitioner submits that the application under Order 39 Rule 1 and 2 of the Code of Civil Procedure is also pending. However, he further submits that the application or temporary injunction is otherwise ready for hearing.

In the light of the submissions made by the learned advocate for the petitioner, CO 1499 of 2025 is disposed of by requesting the learned 1st Civil Judge (Jr. Division) at Alipore to dispose of the substitution application as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

The learned trial judge is further requested to take up the hearing of the injunction application on the next date fixed, if the same is otherwise ready for hearing and make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the pending interlocutory application, the learned trial judge is requested to make an endeavour to see that the Title Suit No. 4471 of 2014, which is pending sine the year 2014, is disposed of as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
