Ms. Jayashree Patra ...For the Petitioner Learned Counsel appearing on behalf of the petitioner submits that the trial of this case is in the verge of completion and the witnesses have already been examined. In such view of the matter, the present application, which was preferred against a direction made by the Court below for potency test of the accused dated 30th May, 2018 has become infructuous. Accordingly, the petitioner does not want to proceed further with the present application.

In such view of the matter, C.R.R. 1406 of 2018 is dismissed for want of prosecution.

The written instruction filed on behalf of the petitioner is taken on record.
