The petitioner assails a notice inviting tender dated May 10, 2021.

Learned advocate appearing for the petitioner submits that, the petitioner is an existing contractor. He refers to the order dated February 10, 2021 by which, the health department accorded permission to temporary and contractual engagement of unskilled scavenging personnel in Bankura Sammilani Medical College and Hospital. He refers to the letter dated March 12, 2021 by which, the existing agency of the petitioner was extended till September 11, 2021. He contends that thereafter, the authorities issued the impugned notice inviting tender on May 10, 2021. The notice was issued during the pandemic period and that, it was difficult for the petitioner to collect all the requisite papers and submit the same in the tender process.

Learned advocate appearing for the State submits that, the submission of tender documents was suitably extended. The petitioner is not prejudiced in any way. In the facts of the present case, the petitioner appears to be engaged in providing scavenging services to

a medical college and hospital. Services of medical colleges and hospitals stands outside the purview of the pandemic restrictions. The petitioner provides scavenging services to the medical college and hospital and at the same time contends that, it is difficult for the petitioner to collect the necessary documents for submission in the tender process. In any event, the date of submission of requisite documents was suitably extended by the State. The writ petition is an attempt by the petitioner to continue with the scavenging work already awarded by preventing completion of the tender process. Such attempt by the petitioner cannot be countenanced. In such circumstances, WPA No.10604 of 2021 is dismissed without any order as to costs.
