Mr. Moyur Sonawane, Ld. PP ...for the State of Maharashtra Learned senior counsel representing the petitioner relies on the decision in Priya Indoria -vs- State of Karnataka & others. reported in (2024) 4 SCC 749 and submits that the petitioner falls within the ambit of the conditions laid down in paragraph 93.4 and would pray for interim anticipatory bail so that she can go to the State of Maharashtra and pray for anticipatory bail in connection with the case where her husband is in custody.

Heard the learned Public Prosecutor for the State of West Bengal. Learned Public Prosecutor for the State of Maharashtra submits that, as of now, the petitioner is not an accused in this case.

In view of the fact that the petitioner is not an accused in the instant case, as of now, the application for anticipatory bail is disposed of without any further order, even as to costs. However, in the event the petitioner is made an accused in this case in future, she shall be at liberty to pray for anticipatory bail or other appropriate relief.

With these observations, the instant application being CRM (A) 1468 of 2025 is disposed of.
