The grievance of the petitioner has been addressed by the police authorities. On the basis of a complaint received by the Inspector-in-Charge, Tehatta Police Station through post, on May 22, 2022, Tehatta Police Station Case No.405 of dated May 22, 2022, under Sections 188/427/506/34 of the Indian Penal Code, has been started. The police authorities have also opined that the petitioner had been granted a decree of eviction and recovery of Khas possession against the respondent nos.4, 5 and 6 in Title Suit No.140 of 2013. The investigation is going on. Notices under Section 41A of the Code of Criminal Procedure, have been issued to all the FIR named accused persons.

Thus, nothing remains to be decided in the writ petition. The investigation initiated by the police authorities shall be reached to its logical conclusion in a free, fair and proper manner. A vigil shall be kept in and around the area,

in order to ensure that no further untoward incident takes place.

This order shall not be construed as an opinion of the court, on the culpability of the respondent nos.4, 5 and 6. Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
