Petitioner Mr. Navanil De Mr. Subhrajit Dey ...for the petitioner Mr. Kaustav Lal Mukherjee ...Amicus Learned counsel appearing on behalf of the petitioner submits as follows. While the petitioner is about 19 years old, the victim girl is aged about 14 years and 6 months. She had voluntarily left with the petitioner. The petitioner has been falsely implicated in this case. Learned Amicus assisting the State relies on the case diary and opposes the prayer for anticipatory bail. He submits that on two successive occasions, the present petitioner kidnapped the minor victim girl. The victim girl was recovered from the petitioner's house. He refers to the recovery memo, the statement of the minor victim girl implicating the petitioner and also the statements of the neighbours of the accused.

Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
