The petitioner is an employee of the Barrackpur Central Zone Wholesale Consumers' Co-operative Society Limited. The petitioner alleges that the co-operative society has not allowed the applicable salary and other benefits corresponding to the post held by the petitioner in the said co-operative society arbitrarily, thereby causing huge financial loss to the petitioner for the last 23 years. Mr. Bhattacharya, learned advocate appearing for the society submits that the allegation of the petitioner is incorrect. The entitlement of the petitioner has been calculated on the basis of the service rules applicable and the petitioner has not been deprived in any way.

As it is a disputed question of fact which need further probe and consideration by the society, the writ petition is disposed of with a direction upon the competent authority of

the society, of which the petitioner is an employee, to dispose of the prayers of the petitioner by treating the writ petition as a representation. The petitioner shall be heard. The petitioner shall be allowed to submit all documents in favour of his contentions. Thereafter, a reasoned order shall be passed and communicated to the petitioner.

The entire exercise shall be completed within a period of three months from date of communication of this order. Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
