Petitioner approached this court for implementing the order passed by the learned Executive Magistrate.
Mr. Samanta, learned advocate appearing for the State submits that after filing of the preemption case, such a recourse has been taken by the petitioner which is not maintainable in law. I find that the dispute and difference which arose refers to incidents of 2023. If the petitioner is faced with inconvenience so far as peace and tranquility is concerned, petitioner would approach the Officer-in-Charge, Jagatballavpur Police Station. The Officer-in-Charge will take steps in accordance with law.
In view of the lapse of time, I am of the opinion further pendency of the writ petition at this
stage is unwarranted as the circumstances are bound to change with the passage of time.
With the aforesaid observations WPA 10588 of 2024 is disposed of.
