22.06.2026 Court No.28 Item No.34 ssi CRM (A) 1347 of 2026 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita in connection with Pingla Police Station Case No. 236 of 2025 dated 15.09.2025 under Sections 85/79/316 (2)/115(2)/109/3 (5) of the BNS 2023 read with Sections 3 /4 of the DP Act.

Petitioners Mr. Navanil De Ms. Monami Mukherjee ...for the petitioners Mr. Krishnendu Bhattacharya Mr. Kaustav Lal Mukherjee ..for the State Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the father in law, the mother in law, the brother in law and the sister in law of the alleged victim. Earlier, the husband was granted anticipatory bail by the Sessions Court. There is three months' delay in lodging the FIR. The marriage between the couple had taken place in 2019.

Learned Additional Public Prosecutor representing the State relies on the case diary and opposes the prayer for anticipatory bail. He refers to the FIR, the statements of witnesses and the medical papers. It appears that the victim was admitted in hospital from 21.05.2025 to 10.06.2025. Although in the FIR which was filed through a petition before the learned Magistrate, the victim stated that the husband had forcibly poured poison into her mouth at the instigation of the other accused, there is a noting in a police injury report dated 28.05.2025 as short history that the patient ingested two teaspoons of unknown

substance on 27.05.2025 after quarreling with her mother in law. There is a signature of the victim below the noting. Considering the above and the other materials available in the case diary and that a charge sheet has already been submitted, I do not think that custodial interrogation of the petitioners is required in this case and I am inclined to grant anticipatory bail to the petitioners.

In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioners shall surrender before the learned jurisdictional Court and pray for bail within four weeks from this date. The petitioners shall not threaten or intimidate the witnesses. The presence of the I.O. is noted and is dispensed with. The application for anticipatory bail is, thus, disposed of. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
