Learned advocate appearing for the petitioner submits that from the joint possession of the petitioner and another 25 kgs. of ganja/contraband was seized. Petitioner is in custody for 1 year 3 months 24 days and after framing of charges till date there has been hardly any progress in the case. The evidence of P.W.1 is in progress.
Learned advocate for the State opposes the prayer for bail.
Having considered the period of detention of the present petitioner, I am of the opinion that further detention of the petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed.
Accordingly, the petitioner namely, Sunil Garai shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees
Twenty Thousand only) with two sureties of like amount each, one of whom must be local to the satisfaction of the learned Special Court, NDPS Act, Jhargram.
If on bail, the petitioner shall not leave the jurisdiction of the district of Jhargram without the permission of the learned special court. Petitioner shall be physically present on each and every date so fixed by the learned trial court. Accordingly, CRM (NDPS) 516 of 2025 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
