Vaisya Mr. Nilay Baran Mandal ...for the DPSC, Purulia From the report of the District Inspector of Schools (P.E.), Purulia it is found that the total number of students in the school where the petitioner presently working is fifty four, where the number of regular teacher including the petitioner is two. Therefore, presently the pupil-teacher ratio of the school is 27:1. If the petitioner is transferred now, the ratio will go up to 54:1 which is against the rule framed under RTE Act, 2009.

Therefore, this application for transfer cannot be entertained at this stage.

However, the petitioner can file separate application if new teacher joins the school and if the pupil-teacher ratio goes down.

The writ application is disposed of.
