Case No.72 of 2026 dated 10.01.2026 under Sections 126(2)/117(2)/118(2)/109(1)/103(1)/3(5) of the BNS, 2023.

And In the matter of: Ashtam Mandal @ Astam Mondal ... petitioner Mr. Robiul Islam Mr. Masooq Rahman ... for the petitioner Ms. Shalini Bairagi ... for the State Learned counsel for the petitioner submits that there was a fight between two groups of people who had come to cremate their respective relatives. After a fight broke out, both sides were received injuries. One person died. The petitioner has been falsely implicated in this case. Learned counsel for the State relies on the case diary and opposes the prayer for anticipatory bail. She refers to the statements of witnesses including that of an independent witness present at page 13 of the case diary. She also refers to the statements of others recorded before the learned Magistrate. Most of the statements implicate the present petitioner as one of the assailants.

Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
