Records of the writ petition reflect that an 22.07.2025 Court No. 35 M/L. No.820 Rakib information was furnished with the Officer-in-Charge of Nalhati Police Station to the effect that the respondent had harvested the crops of the present petitioner which resulted in loss of Rs.60,000/-.

Learned advocate appearing for State has submitted a report. Report reflects that a Civil Suit is pending between the parties being Title Suit No.194/2022.

Having regard to the fact that Civil Court is already in seisin of the issue so far as the right, title, possession and interest is concerned, it would be the Civil Court to adjudicate the same. This Court while exercising its powers under Article 226 of the Constitution of India will not enter into the issues relating to private disputes. Accordingly, WPA 10447 of 2024 is disposed of. Report so submitted by the State be kept with the record.
