Kausik (Allowed) CRM (NDPS) 844 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Lalgola Police Station Case No. 715 of 2025 dated 12th August, 2025 under section 21(C)/29 of the NDPS Act, 1985.

Mr. Rajendra Banerjee, APP Mr. Sankalpa Bhattacharjee ......for the State.

Petitioner is similarly situated as the other accused namely, Rohit Sk @ Rohid Sk. who has been granted bail in CRM (NDPS) 758 of 2026.

Learned advocate for the State opposes the prayer for bail but is however unable to refute the contention that Rohit Sk @ Rohid Sk. and Sabir Hossain @ Md. Sabir Hossain @ Badsha is similarly placed.

Having considered the locus of the present petitioner I am inclined to extend the same relief. As such, prayer for bail of the petitioner is allowed.

Petitioner be released on bail on same terms and conditions as was imposed in CRM (NDPS) 758 of 2026. Accordingly, CRM (NDPS) 844 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
