Kausik (Allowed) CRM (NDPS) 845 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Lalgola Police Station Case No. 833 of 2025 dated 19th September, 2025 under section 21(C)/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits petitioner was arrested on 19.09.2025 and since then he is in custody. Charge sheet has already been submitted before the jurisdictional Court and the prosecution has relied upon 20 witnesses in support of its case.

Learned advocate for the State opposes the prayer for bail.

The recovery in the present case is 341 Gms. of Heroin. Chemical examiner's report reflects 6-Monoacetylmorphine and Diacetylmorphine. Each of them are independent contraband finding its place in the schedule of the NDPS Act. Having regard

to the principles laid down in Sentu Seikh vs. State of West Bengal (SLP (Crl.) No. 13987/2025) and the quantum of recovery in the present case and the fact that there is no possibility of the trial being taken to its logical conclusion in near future, I am inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Md. Mebtahajul @ Meta shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Special Court (under NDPS Act), Berhampore, Murshidabad.

If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Murshidabad without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 845 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
