Nayeemul Hoque ...for the petitioner Mr. Supriya Chattopadhyay Mr. Pinaki Bhattacharya ...for the State The petitioner is the Assistant Headmaster of Dhuliyan High Madrasah (H.S.) whose appointment as Assistant Headmaster has been approved by the District Inspector of Schools (S.E.), Murshidabad on 22.03.2022 as appears from Annexure P-7 of the writ application. The private respondent is working as an Assistant Teacher in the said Madrasah and at the same time he is performing the duty of a Teacher InCharge. When there is one Assistant Headmaster who joined and whose service has been approved, there is no necessity of any Teacher In-Charge and hence the private respondent being respondent No.9 namely Abul Kalam Azad shall not act as Teacher In-Charge of the said Madrasah from today and he shall hand over all papers and documents of the Madrasah which he was using and which are in his custody as the Teacher In-Charge to the petitioner being the

Assistant Headmaster by tomorrow positively and there shall be no Teacher In-Charge in the said Madrasah from today.

With the above direction, this writ application is allowed.
