Petitioner made an application for transfer on general ground (distance) on 10th July, 2022. School authority where petitioner is presently working forwarded the transfer application of the petitioner to the concerned District Inspector of Schools (SE) on 13th July, 2022 for taking further steps. The District Inspector of Schools (SE) on 14th July, 2022 through portal forwarded the transfer application of the petitioner after processing the same to the West Bengal Central

School Service Commission for taking final decision. Grievance of the petitioner is in spite of receipt of transfer application far back on 14th July, 2022 same is yet to be decided by the Commission.

Respondents are represented by learned advocates who have jointly submitted that contemporaneous decision could not be taken on transfer application due to suspension of portal with effect from 29th September, 2022.

However, it is submitted on behalf of West Bengal Central Schools Service Commission if concerned authority is directed transfer application shall be decided in accordance with law.

Having considered the respective submissions made on behalf of the parties writ petition stands disposed of directing the Chairman, West Bengal Central School Service Commission being respondent no. 4 to decide the transfer application of the petitioner by 6 (six) weeks from the date of communication of this order and the decision to be taken by the respondent no. 4 shall be communicated to the petitioner by 10 days thereafter.

It is made clear that suspension of portal shall not be a ground to reject the transfer application of the petitioner.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
