The petitioner participated in a tender process. In such tender process, the petitioner was successful both in the technical as well as in the financial bid stages. The petitioner is yet to be issued the work order. The petitioner made a representation dated April 28, 2021 which is yet to be considered and decided.

Learned Senior Advocate for the State submits that the respondent No. 3 is the appropriate authority to decide such representation.

In such circumstances, it would be appropriate to direct the respondent no. 3 to consider and decide the representation dated April 28, 2021 made by the petitioner, in accordance with law. The respondent No. 3 will afford a reasonable opportunity of hearing to the

petitioner. The respondent no. 3 is at liberty to hear such other authorities and consult such documents as deemed fit and proper. He will pass a reasoned order which he will communicate to the parties. It is expected that the respondent no. 3 completes the entire exercise within a period of four weeks from the date of communication of this order.

W.P.A. 10605 of 2021 is disposed of accordingly.

The parties shall act in terms of the copy of the order downloaded from the official Website of this Court.
