Learned advocate appearing for the petitioner submits that the petitioner is unable to enter his residence and the private respondents are violating the civil court's order. It is also alleged that the petitioner was assaulted.

Learned advocate appearing for the state has submitted a report which reflects that Shyampur Police Station Case No. 154 of 2024 dated 20.04.2024 was registered for investigation under the relevant sections of the Indian Penal Code.

Learned advocate for the private respondent submits that the petitioner being one of the brothers is trying to usurp whole of the property by way of depriving the others. The same is denied by the learned advocate appearing for the petitioner. In case there is a dispute and difference existing between the petitioner and the private respondents which may result to an untoward incident, the Officer-in-Charge, Shyampur Police Station will assess regarding such perception and keep a strict vigil ensuring that no breach of peace takes place at the area concerned referred to in the writ petition.

With the aforesaid observations WPA 10457 of 2024 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate for the petitioner.
