He also complains that a construction is being raised in spite of the learned Civil Judge (Jr. Divn.), 6th Court, Alipore having passed an ad interim injunction order in TS 1946 of 2024.
State has submitted a report which reflects that Maheshtala P.S. Case No. 646 of 2024 dated 26.12.2024 was registered for investigation and the investigation of the said case is under progress. Learned advocate also submits
that the police authorities in the month of April has already drawn up a proceeding under Section 126 of the BNSS.
Since the report reflects that the police authorities have informed the petitioner as well as the respondent(s) to abide by the order passed by the learned Civil Judge (Jr. Divn.), 6th Court, Alipore as also have kept a strict vigil, it is directed that the police authorities would continue their surveillance and ensure that there is no infraction of the order so passed by the learned civil court.
However, it is pointed out that the petitioner has already filed an application under Section 151 of the CPC before the jurisdictional court.
In case, specific directions are passed upon the police authorities to act in a particular mode and manner, the police authorities would respect, obey and implement the said order.
With the aforesaid observations, WPA 9647 of 2025 is disposed of.
Pending application(s), if any, is also disposed of.
Report so submitted be kept with the record. A copy of the report be handed over to the petitioner.
