The petitioners are two out of six accused persons. The charge is one of dacoity.

Three of the accused persons have been granted bail by coordinate Benches of this Court. All the three accused persons were identified in TI Parade including the persons who had been granted bail and the petitioners herein were also so identified. The petitioners clearly stand on the same footing as the accused persons who have been granted bail by this Court.

In view of the aforesaid as also in view of the nature of allegation made against the petitioners, we are inclined to enlarge the petitioners on bail.

Accordingly, we direct that the petitioners shall be released on bail upon furnishing bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of learned Chief Judicial Magistrate, Tamluk. The petitioners shall appear before the trial Court on every date of hearing until further orders and shall not intimidate the witnesses

and/or tamper with evidence in any manner whatsoever. The petitioners shall remain within the jurisdiction of the local police station and shall report to the Officer-in-Charge of the said police station once every fortnight.

In the event the petitioners fail to adhere to any of the conditions stipulated above without justifiable cause, the trial Court shall be at liberty to cancel their bail in accordance with law without further reference to this Court. The application for bail being CRM 3892 of 2021 is, thus, allowed.
