Case No. 243 of 2013 dated 20.04.2013 under Sections 420/406/120B of the IPC subsequently renumbered the same as RC 2252018E0002, dated 24.09.2018 under Sections 120B of the IPC read with Sections 420 and 409 of the IPC and added under Sections 4/5/6 of the Prize Chits and Money Circulations Schemes (Banning) Act, 1978 (Corresponding to G.R. Case No. 514 of 2013). And In the matter of: Prabir Kumar Chattopadhyay ....petitioner Mr. Suman Chakraborty ...for the petitioner.

Heard the learned Counsel for both the parties. 2.

The report as filed by the C.B.I. be taken on record. 3.

The petitioner is alleged to have defrauded number of depositors of about 82 crores with assurance of high return to that. The persons who are stated to have been released on regular bail and anticipatory bail are on better footing then the present petitioner. So far as the present petitioner is concerned, he is alleged to be the joint signatory and the director of the company. 4.

In view of such fact, we are not inclined to exercise our discretion in favour of the petitioner under Section 439 Cr.P.C at this stage.

Accordingly, the prayer for bail of the petitioner is rejected. 6.

CRM (DB) 1637 of 2023 is dismissed.

The petitioner may, however, renew his prayer for bail with better particulars after consideration of charge by the learned Trial Court.
