I have perused the contention advanced by the petitioner and the complaint which was filed before the Learned Chief Judicial Magistrate, Jalpaiguri.

Having regard to the fact that during the specified period, there was a default in payment, I am of the view that no interference is called for at this stage.

Accordingly, CRR 1370 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
