1. By way of this public interest litigation the petitioners allege that the private respondent has encroached a public street by putting up a shop. Consequently, the public of the area are affected.

2. In this regard, a representation was submitted to the District Magistrate, Hooghly which was forwarded to the Sub-Divisional Officer, Arambagh Sub-Division, Hooghly by Memo No.139/P.G.Cell/Hug. dated 08.02.2024 requesting the Sub-Divisional Officer to take immediate necessary action and action taken report to be submitted to the District Magistrate.

3. It appears that pursuant to such direction given by the District Magistrate, no further action has been taken.

4. Since the representation has already been acted upon and appropriate direction has been issued by the District Magistrate to the Sub-Divisional Officer, there will be a direction to the Sub-Divisional Officer,

namely, the 3rd respondent to consider the representation, issue notice to the petitioners and the 7th respondent and take action in accordance with law within a period of twelve weeks from the date of receipt of the server copy of this order.

5. With the above observation, the writ petition stands disposed of.
