The Instant appeal is directed against the judgment and award dated December 19, 2007 passed by the learned Motor Accident Claims Tribunal, 1st Court at Suri, Birbhum in Motor Accident Claim Case No. 133 of 2006. Mr. Amitava Mitra, learned Counsel appearing on behalf of the appellant Insurance Company on instruction submits in Court today that his client / Insurance Company does not wish to pursue the instant appeal any further. He further submits that a sum of Rs.25,000/-, being the statutory amount along with a sum of Rs.2,61,983/- has been deposited in terms of the Court's order dated September 26, 2008 with the learned Registrar General of this Court. He submits that the above sum may be disbursed to the claimants in accordance with law as per the award. In the light of the above submissions, the claimant/respondent Nos.

1 and 2 shall furnish particulars of their respective Bank account with the Registrar General of this Court as expeditiously as possible. Upon deposit of such details, the Registrar General is directed to pay the deposited amount along with any accrued interest to the claimants/respondents in accordance with law. The Registrar General shall check the veracity of the bank accounts and the identity of the claimants before disbursing the amounts.

Such payment must reach the claimants within four weeks from the date of receipt of the Bank details from the claimants/respondents.

With the aforesaid directions the instant appeal is disposed of.

There shall be no further order as to costs.

In view of the disposal of this appeal, connected application, being IA CAN No. 1 of 2008 (Old No. CAN 6546 of 2008) is also disposed of.

The Registry is directed to send down the lower Court records at once, if received by this time. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of all formalities, on priority basis.
